FAHR Responds to 124 legal advice requests during the First Quarter of 2014

The Federal Authority for Government Human Resources (FAHR) confirmed that the Legal Advice Team within the Authority has succeeded, during the first quarter of 2014, in responding to 124 legal advice requests submitted to the team by federal government ministries and entities which are governed by the HR Law in Federal Government and its Executive Regulation and the HR Regulation for Federal Independent Entities.

Her Excellence, Aisha Al Suwaidi; executive director of Human Resources Policies Sector within FAHR, has pointed out in details that the Authority’s legal Advice team, which was established in 2010 with the purpose of creating a sound legal culture amongst federal government employees relating to HR legislations, policies and rules applied at federal government level, through responding to enquiries and requests from federal government employees, has received 104 enquiries through FAHR website  www.fahr.gov.ae and 20 requests through toll free telephone No. 600525524.

  She added that the legal advice requests focused on a number of key issues, such as housing allowance, which came up top amounting to 18% of the total number of enquiries; vacations which scored 14% and appointments by 11% out of the total number of legal requests submitted to the team.

 Aisha Al Suwaidi noted that the ministries that showed more interest in exploiting this legal advisory service were the Ministry of Health, Ministry of Education, Ministry of Public Works and Ministry of Economy, while the federal independent entities that showed more interest in submitting legal advice requests included the General Authority of Islamic Affairs and Endowments, The General Authority Of Aviation, the National Qualifications Authority and the Zakat Fund.

 Al Suwaidi explained that the mechanism adopted by the team is to offer legal advice, study cases which are raised by federal government employees and by HR and legal departments within federal entities with regard to the laws and legislations and HR policies within the federal government. The team aims at unifying legal opinions in all cases brought before the Authority and to document legal principles in order to facilitate the smooth running of work procedures in the future. 

She pointed out that FAHR has proceeded to divide the legal advice work team into two , whereby the first group undertakes the task of responding to queries received from ministries which are governed by the HR law and it’s Executive Regulation, while the other group is to be responsible for responding to inquiries received from independent entities governed by the HR Regulation.

The executive director of Human Resources Policies Sector stated that Arabic is considered the official language for formulating responses to legal advice requests revealing that the time frame for compiling a final response to each enquiry is between one to five working days at the latest.

According to Aisha Al-Suwaidi, the legal advice team has carried on its activity in a dynamic and energetic manner throughout 2013, where it succeeded in handling 320 legal advice requests received by the Authority, of which 220 requests were raised by federal government entities governed by the HR Law and it’s Executive Regulation amounting to 69% of the total enquiries received, and 75 enquiry were submitted by Independent federal entities. During the year 2012, the legal advice teal dealt with 313 enquiries from federal government ministries and entities and 640 enquires during the year 2011.

On a related vein, it is worth mentioning that the Authority has recently launched the “Do you Know?” and “An Eye on” programs, which are sort of weekly awareness raising leaflets aiming at raising awareness on the part of employees in federal government ministries and entities governed by the HR Law and it’s Executive Regulation and independent federal entities governed by HR regulations. This step comes within the framework of the Authority’s keenness to ensure sound application of the HR laws, rules and regulations within the federal government.
